These Terms and Conditions ("Terms") govern your use of the services provided by Welcomed, a WestMark Company. Welcomed provides short-term rental property management services. By using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.
1. Definitions
- "Company, " "we," "our," or "us" refers to Welcomed
- "Client" or "you" refers to the property owner or their authorized representative who engages the services of the Company.
- "Guest" refers to any person or group who stays on a single reservation at the property managed by the Company.
- "Property" refers to the short-term or mid-term rental property managed by the Company.
2. Services Provided
Welcomed provides property management services for short-term and mid-term rental properties, including but not limited to:
- Marketing and listing the property on short-term rental platforms.
- Coordinating guest bookings and communication.
- Managing guest check-in and check-out procedures.
- Housekeeping and maintenance coordination.
- Handling guest inquiries and complaints.
- Collection and remittance of applicable taxes.
3. Client Responsibility
- Property Maintenance: The Client must ensure that the property is in good condition and complies with all relevant laws and regulations.
- Insurance: The Client must maintain appropriate insurance coverage for the property, including liability insurance.
- Access: The Client must provide the Company with access to the property as needed to perform management duties.
4. Fees and Payments
- Management Fee: The Client agrees to pay the Company a management fee as agreed upon in the separate management agreement.
- Payment Schedule: Payments are due according to the schedule outlined in the management agreement.
- Additional Costs: The Client is responsible for any additional costs incurred, such as maintenance and repair expenses, as outlined in the management agreement.
5. Booking and Cancellation Policies
- Guest Bookings: All guest bookings are subject to the terms and conditions of Welcomed policies.
- Cancellations: The company will follow the cancellation policy set forth by the short-term rental platform. Any cancellation fees or penalties will be the responsibility of the Clent.
6. Liability and Indemnification
- Liability: The Company is not liable for any damages, loss, or injury to persons or property arising from the use of the property. The Client agrees to indemnify and hold the Company harmless from any claims, damages, or expenses arising from the Client's use of the property or the services provided by the Company.
- Force Majeure: The Company is not liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, acts of God, or government actions.
7. Termination
- Termination by Client: The Client may terminate the management agreement by providing written notice to the Company 30 days in advance.
- Termination by Company: The Company may terminate the management agreement by providing written notice to the Client 30 days in advance or immediately in the event of a material breach of these Terms by the Client.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of Texas, without regard to its conflict of law principles.
9. Amendments
The Company reserves the right to amend these Terms at any time. The Client will be notified of any changes, and continued use of the services constitutes acceptance of the amended Terms.
10. Disclaimer of Liability for Theft
The management company, Welcomed, a WestMark Company, hereby disclaims any responsibility or liability for any loss, damage, or theft of personal property occurring during the guest’s stay at the short-term rental property. Guests are advised to secure their belongings and valuables appropriately. By booking and staying at the property, guests acknowledge and accept that the management company shall not be held liable for any theft-related incidents.
